Notice in this video that Elena Kagan never answers Senator Coburn's question. His hypothetical is really about the health care bill as many have suggested the Commerce Clause of the Constitution gives the authority to the federal government to force us to buy health insurance (or whatever else they want.)
I don't know if it's more scary to have a potential Supreme Court nominee look like a mule looking at a new fence when asked a Constitutional question or the fact that continuing on the current track could someday make Senator Coburn's hypothetical reality.
